Terms of Service

1. Acceptance of Terms

By accessing or using the SHVIDLIK website, WebAR platform, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Services.

2. Description of Service

SHVIDLIK provides a zero-logistics WebAR loyalty platform for the family leisure and hospitality sector. Our Services include venue-branded activity kits, character collection gamification via QR-code scanning, and a digital passport system for children.

3. Fair Use of the WebAR App

You agree to use the SHVIDLIK WebAR app and platform only for lawful purposes and in accordance with these Terms. Prohibited activities include:

  • Attempting to reverse-engineer, decompile, or extract source code from our WebAR experiences.
  • Using automated scripts or bots to artificially inflate scan counts or character unlocks.
  • Interfering with the integrity or performance of the platform.
  • Using the platform to harass, abuse, or harm other users.

4. Intellectual Property

All SHVIDLIK characters, visual assets, logos, storylines, and platform code are the exclusive intellectual property of SHVIDLIK and its licensors. You may not:

  • Clone, copy, reproduce, or create derivative works of SHVIDLIK characters or assets for commercial purposes.
  • Use SHVIDLIK branding or characters in third-party products, games, or marketing materials without written authorisation.
  • Claim ownership or authorship of any SHVIDLIK intellectual property.

Venue partners receive a limited, non-exclusive licence to use SHVIDLIK-branded materials solely within their contracted premises and marketing channels.

5. User Accounts

Parents or guardians may create child accounts through the Shvidlik Passport system. You are responsible for maintaining the confidentiality of login credentials and for all activity that occurs under your account. SHVIDLIK reserves the right to suspend accounts that violate these Terms.

6. Venue Partnership Terms

Restaurants, hotels, cruise lines, and other hospitality venues may subscribe to SHVIDLIK under a separate SaaS agreement. Subscription fees, print quotas, and support terms are governed by the specific contract executed between the venue and SHVIDLIK.

7. Disclaimers

The Services are provided "as is" without warranties of any kind, either express or implied. SHVIDLIK does not guarantee that the WebAR experience will function on every device or browser configuration. We recommend modern smartphones with camera and web capabilities.

8. Limitation of Liability

To the maximum extent permitted by law, SHVIDLIK shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the use of our Services.

9. Changes to Terms

We may modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the revised Terms. We will notify users of material changes via email or in-app notice where possible.

10. Governing Law

These Terms are governed by the laws of the Republic of Croatia, EU. Any disputes shall be resolved in the competent courts of Croatia.
